01 / Notice components
A rights owner or authorized agent should prepare a signed written notice that includes:
- Identification of the copyrighted work, or a representative list where multiple works are covered.
- Identification and exact location of the material at issue, including enough URL information to find it.
- The claimant’s name and reliable postal, telephone, and email contact details.
- A good-faith statement that the disputed use is not authorized by the owner, its agent, or law.
- A statement under penalty of perjury that the information is accurate and the signer owns the right or is authorized to act.
- A physical or electronic signature of the authorized person.
Missing elements can prevent an informed review. A person who knowingly makes a material misrepresentation may face legal consequences.
02 / Counter-notification
A provider who believes material was disabled through mistake or misidentification may prepare a signed counter-notification identifying the removed material and former location, providing complete contact details, and stating under penalty of perjury the good-faith belief that the action was mistaken. It should also include the jurisdiction and service-of-process consents required by applicable law.
A legally sufficient counter-notification may be forwarded to the original claimant. Restoration may occur after the applicable statutory interval unless the claimant reports an action seeking a court order.
03 / Repeat infringement
In appropriate circumstances, repeat infringers may have access restricted or terminated. The operator may also disable material when a substantiated claim or applicable legal duty warrants action.
