01 / Notice components

A rights owner or authorized agent should prepare a signed written notice that includes:

  1. Identification of the copyrighted work, or a representative list where multiple works are covered.
  2. Identification and exact location of the material at issue, including enough URL information to find it.
  3. The claimant’s name and reliable postal, telephone, and email contact details.
  4. A good-faith statement that the disputed use is not authorized by the owner, its agent, or law.
  5. A statement under penalty of perjury that the information is accurate and the signer owns the right or is authorized to act.
  6. A physical or electronic signature of the authorized person.

Missing elements can prevent an informed review. A person who knowingly makes a material misrepresentation may face legal consequences.

02 / Counter-notification

A provider who believes material was disabled through mistake or misidentification may prepare a signed counter-notification identifying the removed material and former location, providing complete contact details, and stating under penalty of perjury the good-faith belief that the action was mistaken. It should also include the jurisdiction and service-of-process consents required by applicable law.

A legally sufficient counter-notification may be forwarded to the original claimant. Restoration may occur after the applicable statutory interval unless the claimant reports an action seeking a court order.

03 / Repeat infringement

In appropriate circumstances, repeat infringers may have access restricted or terminated. The operator may also disable material when a substantiated claim or applicable legal duty warrants action.
